Adoption Statement
This statement is published by Brighton & Hove City Council (”the council”) pursuant to Regulation 14 of the Town and Country Planning (Local Planning) (England) Regulations 2012 (“the Regulations”).
The Biodiversity and Nature Conservation SPD was adopted by the council on the 16 June 2022. The SPD provides guidance on planning matters related to biodiversity and nature conservation. It supplements the City Plan policy and, where planning permission is needed, will be a material consideration in determining planning applications.
Under Section 23 (1) of the Planning and Compulsory Purchase Act 2004, the council has modified the SPD to take into account representations made in relation to the document and any other relevant matters. Modifications are included in the Statement of Consultation.
The Regulations provide that an Adoption Statement must specify that any person with sufficient interest in the decision to adopt the SPD may apply to the High Court for permission to apply for judicial review of that decision and that any such application must be made promptly and in any event not later than 3 months after the date on which the SPD was adopted. The Biodiversity and Nature Conservation SPD, Statement of Consultation and this Adoption Statement are available to view on the Council’s website. The documents are also available for inspection on request at Hove Town Hall.
