Town and Country Planning (Local Planning) (England) Regulations 2012
This statement is published by Brighton & Hove City Council ("the council") according to Regulation 14 of the Town and Country Planning (Local Planning) (England) Regulations 2012 ("the Regulations").
Brighton & Hove City Council adopted the Design Guide for Extensions & Alterations SPD on 16 January 2020.
The SPD provides guidance on planning matters related to extension design. It supplements the City Plan policy and, where planning permission is needed, will be a material consideration in determining planning applications.
Under Section 23 (1) of the Planning and Compulsory Purchase Act 2004, we have modified the SPD to consider representations made about the document and any other relevant matters. Modifications are included in the Statement of Consultation.
The Regulations provide that an Adoption Statement must specify that any person with sufficient interest in the decision to adopt the SPD may apply to the High Court for permission to apply for judicial review of that decision.
Any such application must be made promptly and not later than 3 months after we adopted the SPD.
Due to the delay in publishing this Adoption Statement, the 3 months specified in the Regulations have now passed.
