Neighbourhood Plan examination update 

Following completion of the supplementary Regulation 16 consultation, the Neighbourhood Plan examiner Mr Jeremy Edge BSc FRICS MRTPI has resumed the examination of the Hove Station Neighbourhood Plan starting from 20 March 2023.

The examination is expected to take up to 8 weeks to complete. It is expected that the examination will be conducted through written representations only, however this will be decided by the examiner based on the scale and nature of any representations or other issues.

Supplementary Regulation 16 Consultation 

During the Hove Station Neighbourhood Plan examination, the examiner identified some issues with the Basic Conditions Statement supporting the Plan. The examiner therefore temporarily suspended the examination in May 2022 to enable the Neighbourhood Forum to make amendments to the Basic Conditions Statement document. This will assist the examiner to assess whether the Neighbourhood Plan meets the basic conditions and legal requirements set out in the Neighbourhood Plan Regulations and other relevant legislation.  

The Neighbourhood Forum has now submitted the amended Basic Conditions Statement to the council, and we are publishing the revised document for comment.  

In accordance with Regulation 16 of the Neighbourhood Planning Regulations 2012 (as amended), the Neighbourhood Plan and associated documents will go out to consultation from 00.00 on Thursday 3 November 2022 for 6 weeks until 23:59 on Thursday 15 December 2022. 

Please note: This consultation is supplementary to the earlier Regulation 16 consultation undertaken from 20 May to 15 July 2021. It focuses only on the Basic Conditions Statement as now amended. All the other Neighbourhood Plan documents remain exactly as published for consultation in May 2021.  

We invite representations on the amended Basic Conditions Statement and any implications for the other Neighbourhood Plan documents (which remain unchanged). Where possible, please provide any comments using the Consultation Portal

Neighbourhood Plan examination – update 12 May 2022

The Neighbourhood Plan examiner has identified some issues with the Basic Conditions Statement supporting the Neighbourhood Plan.

Following a recent meeting involving the Examiner, council officers and members of the Neighbourhood Forum’s Steering Group, it has been agreed that the Neighbourhood Plan examination will be suspended temporarily to enable the Neighbourhood Forum to make amendments to the Basic Conditions Statement. 

The council will then undertake a supplementary Regulation 16 consultation to invite any comments on the amended Basic Conditions Statement. No changes will be made to the Neighbourhood Plan itself or to any of the other supporting documents.

After the supplementary consultation, we will resume the Neighbourhood Plan examination. Any comments submitted to the supplementary consultation will be considered by the Examiner together with all representations previously submitted to the consultation held May to July 2021.

We expect the supplementary Regulation 16 consultation to take place for 6 weeks starting from the end of August and continuing until mid-October. The Neighbourhood Plan examination will then be able to resume in late November or early December 2022.

The examination commenced on 24 January 2022 and is expected to take around 2 to 3 months to complete. Regulation 16 Consultation

Hove Station Neighbourhood Forum has prepared a Neighbourhood Plan. The Plan sets out a vision for the future of the Hove Station Neighbourhood Area and includes planning policies which will be used to help determine planning applications locally. The Neighbourhood Forum undertook Regulation 14 public consultation on the draft Plan in 2019.

In accordance with Regulation 16 of the Neighbourhood Planning Regulations 2012 (as amended), the Neighbourhood Plan and associated documents will go out to consultation from 9am on Thursday 20 May 2021 for 8 weeks until 11:59pm on Thursday 15 July 2021.

We invite representations on the draft submission plan and supporting documents. Where possible, please provide any comments using the Consultation Portal.

Hove Station Neighbourhood Forum Renewal Application Approval September 2019

The Hove Station Neighbourhood Forum redesignation was approved on 18 September 2019.  

The forum applied to the council to formally renew its designation in accordance with the Town and Country Planning Act 1990 the Localism Act 2011 and the Neighbourhood Planning (General) Regulations 2012.

The neighbourhood area boundary remains identical to the original boundary that was designated in 2014. Renewal enables the Hove Station Neighbourhood Forum to continue to prepare the Hove Station Neighbourhood Plan for the area.

Consultation on the renewal of the Hove Station Forum Designation took place for a period of 6 weeks starting on 4 July 2019 and closing on 15 August 2019.

Background to Hove Station Neighbourhood Forum and Area

Hove Station neighbourhood forum submitted applications in December 2013 for the designation of a neighbourhood area and to have their forum formally designated. These were open to public consultation from 6 January to 17 February 2014. Both applications were considered at Economic Development & Culture Committee on 18 September 2014. The area sought was refused, however, a smaller area was designated as the Hove Station Neighbourhood Area. The Hove Station Neighbourhood Forum designation was therefore subject to the submission of amendments to accord with the smaller area.  Following the submission of the necessary details the Hove Station Neighbourhood Forum was designated on 23 December 2014.  In accordance with the Regulations, the following information is provided along with a link to a copy of the decision note:

Strategic Environmental Assessment

Brighton & Hove City Council has carried out a screening exercise to determine whether the Hove Station Neighbourhood Plan will require a Strategic Environmental Assessment (SEA). The screening exercise indicates that an SEA will be required covering a number of issues. This has been confirmed following consultation with the statutory environmental bodies, as required by the Strategic Environmental Assessment Regulations (Environmental Assessment of Plan and Programmes Regulations 2004).
