Amendments to the Community Infrastructure Levy Regulations
On 1 September 2019 new Community Infrastructure Levy Regulations came into force (the Community Infrastructure Levy (Amendment)(England)(No 2) Regulations 2019) amending the Community Infrastructure Levy Regulations 2010 (‘the CIL regulations’) along with updated guidance contained within the national Planning Practice Guidance. The regulations make a number of important changes to the operation of CIL and section 106 planning obligations. It is not considered that the changes made have any implications for the submitted Brighton & Hove CIL Charging Schedule.
Consultation on Proposed Modifications to draft Charging Schedule 17 July to 11 September 2019
Following the public hearing session held on 2 April and further work submitted by the Council, the independent CIL Examination Inspector agreed proposed main modifications for consultation between 17 July and 11 September 2019. The council also consulted on additional minor modifications. Representations were invited on the modifications only.
The proposed main modifications and additional minor modifications are available for inspection in the CIL Examination Library and are also available at public deposit points.
Examination in Public
On 16 January 2019, Brighton & Hove City Council submitted a Community Infrastructure Levy draft charging schedule (PDF 1.4MB) modified by a statement of modifications to the draft charging schedule (PDF 1.5MB) published in December 2018, for an independent examination in accordance with the Planning Act 2008 (as amended by the Localism Act 2011) and the Community Infrastructure Levy Regulations 2010 (as amended).
A public hearing was held on 2 April 2019 at 10am in Committee Room 3 at Brighton Town Hall, Bartholomew Rd, Brighton BN1 1JW.
At the close of the hearing the Inspector requested some further work to be undertaken by the council and its viability consultant. The scope of this further work is set out in the following note:

Examiner and Programme Officer
Mr Jameson Bridgwater PGDipTP MRTPI has been appointed as the independent examiner to conduct the Examination.
Pauline Butcher has been appointed as Programme Officer. She is independent of the city council and will be the means by which the examiner has contact with the council and representors.
