Brighton & Hove City Council are committed to protecting your personal information. As a data controller we have a responsibility to make sure you know why and how your personal information is being collected in accordance with relevant data protection law.

Purposes and lawful basis of processing

We are collecting your data for the purpose of responding to your complaint or query in relation to the Hackney Carriage Office and its drivers. If necessary, your information may be used to support any investigations and may result in being used in legal action taken against a driver. For those who are contacting regarding lost property, we will use your information to try to locate any lost items.

Our lawful basis for processing is performance of a task carried out in the public interest or official authority, as the council has powers under the Local Government (Miscellaneous Provisions) Act 1976.  We also have a legal obligation under this act to ensure that only fit and proper persons hold a driver’s licence.

We may also process special category data, and our lawful basis for doing so is substantial public interest, specifically relating to the Data Protection Act 2018, Schedule 1, Part 2, Paragraph 12 ‘Statutory etc. and government purposes’; Paragraph 18 ‘safeguarding children and individuals at risk’.

Who we will share your data with

We may share details of the complaint or query with other local authorities and the Police, depending on the situation. We may also share details with other teams in the council, should it be relevant, however, this will again depend on the nature of the complaint or query. For those who have contacted regarding lost property, if we have located the lost item we may share your details with the driver, but only with your express permission.

How long we will hold your data (retention)

If the complaint or query is regarding a licenced driver we will hold your information until the investigation into the matter is closed, plus six years. If their licence is revoked, information may be held for up to 25 years.

Should the complaint or query be regarding anything other than a licenced driver, we will hold your information for six years from when the issue has been dealt with.

Transferring data outside the European Economic Area

Your information is not processed outside of the European Economic Area.
