The owner of the Good News newsagent at 33 Sydney Street in historic North Laine has removed a number of alterations to his shop front after being served a planning enforcement notice.

A cash machine (ATM) was installed without planning permission, along with additions such as black panelling, roller shutters and other alterations considered not in keeping with the character and appearance of the North Laine Conservation Area.

The council served an enforcement notice on 7 September 2009 which the owner appealed. This was dismissed in April this year.

Councillor Lynda Hyde, chairman of Brighton & Hove’s planning committee, said: "This case highlights the council's commitment to maintaining the character and appearance of our Conservation areas. 

“It also shows that sometimes it is not always easy to resolve a breach of planning control quickly despite officers best efforts and sometimes enforcement notices have to be issued in order to get a satisfactory resolution."

The owner also appealed against the council’s original decision in May last year not to allow the shop to keep the ATM. The appeal was turned down by an independent planning inspector in December.

At the time, the planning inspector commented: “In my opinion the ATM is out of scale and dominates the shop front to an unacceptable degree.  Moreover, it significantly reduces views into the retail space from the street thereby eroding the active frontage which is characteristic of the street scene.”
