Querying a benefit overpayment

Understanding the letters you receive about overpayments

You can read our guidance notes to the letters you receive informing you of an overpayment.

Finding out more:  requesting a written ‘statement of reasons’ for an overpayment

If you’d like more information on how an overpayment has been calculated, you can ask us for a statement of reasons setting out how the overpayment occurred and why we are asking you to pay it back.  Requests for a statement of reasons must be received within one calendar month of the benefit decision letter you received from us about the overpayment.  However, if your request for a statement of reasons is received after the time limit, we will still respond with an explanation of how the overpayment occurred.

Requests for a statement of reasons must be made in writing either by email to:  housing.benefits@brighton-hove.gov.uk or by post to:

Benefits Service
Brighton & Hove City Council
PO Box 2929
Brighton, BN1 1PS

Please remember to quote your claim reference and full name in your email or letter.

How to find us

If you think an overpayment is wrong:  appealing against an overpayment

If you think we should not be asking you to repay an overpayment, you have the right of appeal. Your appeal must be made in writing (either by email or by post) and received within one calendar month of the date the overpayment letter was sent to you. If your appeal is received after one calendar month it may not be considered. In your appeal, you’ll need to state the reasons why you disagree with the amount you’ve been asked to pay back.

Appeals should be sent to:  housing.benefits@brighton-hove.gov.uk or by post to:

Benefits Service
Brighton & Hove City Council
PO Box 2929
Brighton, BN1 1PS

Please remember to quote your claim reference and full name in your email or letter.

Further information on the procedure for appealing against benefit decisions can be found on our appeals page.
